1. Introduction

Welcome to The AI-Powered Agency Challenge (the "Challenge") operated by Markeity LLC ("Company," "we," "our," or "us").

These Terms and Conditions ("Terms") govern your participation in our free 3-day live challenge, as well as any purchases of VIP upgrades or digital products (collectively, the "Services").

By registering for the Challenge, purchasing any products, or accessing our content, you agree to be bound by these Terms. If you do not agree, please do not register or purchase.

2. Eligibility

The Challenge is open to individuals who are at least 18 years old.

By participating, you represent and warrant that:

• You are 18 years of age or older

• You will provide accurate and complete registration information

• You are not located in a country that is subject to trade sanctions

• You have the legal capacity to enter into these Terms

3. The Free Challenge

3.1 Registration

Registration is free and requires a valid email address. Each person may register only once. Multiple registrations from the same individual may be disqualified.

3.2 Live Sessions

The Challenge consists of three live sessions conducted on dates and times specified on the registration page. Session times are subject to change with reasonable notice.

3.3 Replays

Free registrants receive access to session replays for 48 hours after each live session. After 48 hours, access expires unless you have purchased VIP access.

3.4 WhatsApp Community

Free registrants may join the main WhatsApp community. The Company reserves the right to remove any participant who violates community guidelines, including but not limited to harassment, spamming, or inappropriate behavior.

4. VIP Ticket Purchase

4.1 Pricing Structure

VIP tickets are priced based on when you purchase relative to the challenge start date:

• First 7 days: €45

• Days 7-14: €65

• Days 14-21: €95

Prices are in Euro (€) and are non-negotiable.

4.2 What's Included

VIP ticket holders receive:

• Access to all three live challenge days

• Lifetime access to replays (not just 48 hours)

• Day 4 VIP Exclusive Training

• Done-For-You Client Kit (digital download)

• Complete AI Prompt Vault (digital download)

• VIP-Only WhatsApp Group access

• VIP Completion Certificate + Badge

All digital products are delivered via download links or access to private online portals.

4.3 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service. We do not store your payment information.

5. Workbook Purchase

5.1 Pricing

The Freedom Workbook is available for €27 (one-time payment).

• Completion Certificate

5.3 Delivery

The workbook is delivered via instant PDF download immediately after purchase. A download link is also sent to your email address.

6. Refund Policy (Important — EU Consumer Rights)

6.1 Right of Withdrawal for EU Consumers

Under the EU Consumer Rights Directive, consumers in the European Union have the right to withdraw from a purchase within 14 days without giving any reason.

However, for digital content, this right is lost once you have expressly agreed to immediate access and the download or access has begun.

By purchasing VIP tickets or the Freedom Workbook, you:

• Expressly request immediate access to the digital content

• Acknowledge and agree that your right of withdrawal expires once the digital content is downloaded or accessed

6.2 No Refunds for Digital Products

Refunds are not provided for VIP tickets or the Freedom Workbook once:

• The download link has been delivered, or

• Access to the content has been granted

This applies even if you have not yet viewed or used the content. The 14-day withdrawal period expires upon delivery of digital access.

6.3 Exceptions

Refunds may be considered in the following limited circumstances:

• Technical issues that prevent access to purchased content (e.g., corrupted files, inaccessible downloads)

• Duplicate charges due to payment processing errors

In such cases, contact us at info@markeity.com. We will first attempt to resolve technical issues. If the issue cannot be resolved within a reasonable time, a refund may be issued at our discretion.

6.4 How to Request a Refund (If Eligible)

To request a refund under the limited circumstances above, email info@markeity.com with:

• Full name used for purchase

• Email address used for order

• Product purchased (VIP or Workbook)

• Order date and payment reference

• Description of the issue

Incomplete requests may delay processing.

6.5 Refund Processing

Approved refunds are processed within 14 days of confirmation and are issued to the original payment method.

7. Intellectual Property Rights

7.1 Our Content

All content provided during the Challenge, including but not limited to videos, slides, worksheets, prompts, templates, and written materials, is the exclusive property of Markeity LLC and is protected by copyright and intellectual property laws.

7.2 License to Use

When you purchase our digital products, you receive a limited, non-exclusive, non-transferable license for personal, non-commercial use. You may not:

• Share, resell, or redistribute any content

• Modify or create derivative works

• Use our content to train AI models or for commercial purposes outside your own business

• Share login credentials or group access links

Violation of these terms may result in immediate termination of access without refund.

7.3 Rights Granted by You

By posting content in our WhatsApp communities (including text, images, or feedback), you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for promotional purposes.

8. WhatsApp Community Rules

8.1 Code of Conduct

By joining our WhatsApp groups, you agree to:

• Be respectful to all members

• Refrain from harassment, hate speech, or inappropriate content

• Avoid spamming or self-promotion without permission

• Keep discussions relevant to the Challenge and agency-building

8.2 Enforcement

We reserve the right to remove any member violating these rules without warning and without refund of any VIP fees.

8.3 Group Modifications

We may modify, merge, or close WhatsApp groups at our discretion. VIP groups are subject to the same moderation policies.

9. Disclaimer of Guarantees

9.1 No Earnings Guarantees

We make no guarantees regarding your ability to earn money or achieve specific results from participating in the Challenge or implementing any strategies taught.

Our €74k/month result is our own experience and not typical. Individual results vary based on effort, skill, market conditions, and numerous other factors. Any examples shown are not promises or guarantees.

9.2 "As Is" Basis

All content and services are provided on an "as is" basis without warranties of any kind, either express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, Markeity LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Challenge or use of our products.

Our total liability shall not exceed the amount you paid us, if any, in the preceding 12 months.

11. Modifications and Cancellation

11.1 Changes to the Challenge

We reserve the right to modify, suspend, or cancel the Challenge or any part thereof at any time for reasons beyond our control.

11.2 Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through our website. Continued participation constitutes acceptance of updated Terms.

This Challenge and its promotions are in no way sponsored, endorsed, administered by, or associated with:

• Meta (Facebook, Instagram)

• LinkedIn

• TikTok

• X (Twitter)

• Zoom

• WhatsApp

• or any other social media or technology platforms used to share this Challenge

You understand that you are providing your information to Markeity LLC and not to any third-party platform.

13. Governing Law

These Terms shall be governed by the laws of California, USA, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved exclusively in the courts of Los Angeles County, California.
